§1Scope and Acceptance
1.1 By accessing or using the Umenka website at any of its domains and subdomains (the "Service"), you ("User" or "You") agree to be bound by these Terms of Use (the "Terms"). If You do not agree to these Terms, You must not access or use the Service.
1.2 The Service is operated by the natural or legal person identified in §18 below (the "Operator", "we", "us", or "our"). These Terms supplement and do not replace any applicable law of the Republic of Austria or of the European Union.
1.3 These Terms apply to all visitors of the Service regardless of country of residence. Specific rights granted to consumers under European Union law continue to apply.

2.2 The Service is provided free of charge. No user account, registration, payment, or subscription is required.
2.3 The Operator may at any time and without prior notice modify, add, suspend, restrict access to, or remove any feature, page, or content of the Service.
§3Permitted Use
Subject to these Terms, You are granted a personal, non-exclusive, non-transferable, revocable right to use the Service for the following purposes free of charge and without further permission:
3.1 To access, view, read, and study any publicly available content on the Service for the purpose of learning the Russian language or related subjects.

3.5 To use the downloadable cheatsheet PDFs in non-commercial educational settings, including private tutoring and classroom handouts, provided the Umenka attribution printed on each cheatsheet is not removed or obscured.
§4Restrictions
You may not, without express prior written permission from the Operator, engage in any of the following:
4.1 Reproduce more than one (1) page of Umenka original content on any other website, application, publication, broadcast, course, or other distribution channel.
4.2 Bulk-download, scrape, mirror, harvest, or otherwise systematically extract content or data from the Service by any automated means, including but not limited to web crawlers, bots, scripts, or browser-automation tools.
4.3 Use any content from the Service, in whole or in part, to train, fine-tune, evaluate, benchmark, or otherwise improve any machine-learning model, including large language models, image-generation models, or speech models. Access by AI-training crawlers is expressly prohibited and is signalled to crawlers via robots.txt and via the "noai, noimageai" meta directive embedded in every page.
4.4 Sell, license, sublicense, or otherwise commercialise any product, service, or work whose principal value derives from Umenka content.
4.5 Frame, embed, in-line, or otherwise display the Service or any of its content within another website or application in a manner that disguises Umenka as the source.
4.6 Remove, alter, obscure, or interfere with any copyright notice, attribution, license declaration, watermark, or branding present in or with the Service or its content.
4.7 Use the Service in any manner that violates applicable law, infringes the rights of any third party, or interferes with other users' enjoyment of the Service.
§5Intellectual Property
5.1 Original content. All text, illustrations, layouts, comprehension questions, stories, example sentences, About-page text, curated CEFR labels, About-this-verb notes, FAQ answers, and any other materials created by or for the Operator (collectively, the "Original Content") are protected by copyright and other applicable intellectual-property rights. The Operator retains all rights in the Original Content not expressly granted to You in §3. No further licence is granted by implication, estoppel, or otherwise.
5.2 Verb-paradigm data. The Russian verb conjugation paradigms displayed in the dictionary section of the Service are adapted from the Badestrand Russian Dictionary (https://github.com/Badestrand/russian-dictionary), licensed by its authors under Creative Commons Attribution-ShareAlike 4.0 International (CC BY-SA 4.0). Any reproduction or redistribution of the paradigm data (including the version corrected and supplemented on the Service) must comply with the CC BY-SA 4.0 licence: it requires visible attribution to Badestrand, indication that the data has been modified, and the application of the same share-alike licence to any derivative work. The CC BY-SA 4.0 licence does not extend to the Original Content described in §5.1.
5.3 Trademarks. "Umenka" and any associated logos, wordmarks, or brand elements are protected as trademarks or commercial designators of the Operator. These Terms do not grant any right to use them.
5.4 Reservation. Any use of Service content outside the scope of §3 or §5.2 requires the Operator's prior written consent.
§6Third-Party Content and External Links
6.1 The Service may link to or reference third-party websites, repositories, dictionaries, or other resources. The Operator does not endorse, control, or assume responsibility for the availability, accuracy, security, or content of any such third party.
6.2 Your use of any third-party site or resource is at Your own risk and subject to the terms and policies of that third party.
§7Service Availability
7.1 The Operator does not guarantee that the Service will be available without interruption, free of errors, or secure against attack.
7.2 The Operator may, at any time and for any reason, suspend, restrict, or discontinue the Service in whole or in part without notice and without liability to any User.
§8Disclaimer of Warranties
8.1 The Service and all content are provided "as is" and "as available", without warranty of any kind, whether express or implied. To the maximum extent permitted by applicable law, the Operator disclaims all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, and non-infringement.
8.2 In particular, the Operator does not warrant that linguistic information on the Service (including verb conjugations, stress marks, translations, grammar explanations, CEFR levels, and example sentences) is accurate, complete, current, or suitable for academic citation, professional translation, certification examinations, or any other specific purpose. Users should verify any linguistically critical information against authoritative sources before relying on it.
§9Limitation of Liability
9.1 To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with Your use of, or inability to use, the Service, including damages for loss of data, loss of profits, business interruption, or loss of goodwill, even if the Operator has been advised of the possibility of such damages.
9.2 To the maximum extent permitted by applicable law, the Operator's aggregate liability to any single User in connection with the Service shall not exceed one hundred euros (€100).
9.3 Nothing in these Terms excludes or limits the Operator's liability for: (a) personal injury or death caused by the Operator's negligence; (b) intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit); (c) any liability that cannot be excluded or limited under mandatory provisions of Austrian consumer-protection law (Konsumentenschutzgesetz, KSchG) or other mandatory provisions of Austrian or EU law applicable to consumers.
9.4 If You are a consumer (Verbraucher) within the meaning of the KSchG, the limitations in §9.1 and §9.2 apply only to the extent compatible with mandatory consumer-protection law.
§10Indemnification
10.1 You agree to defend, indemnify, and hold harmless the Operator, its agents, and contributors from and against any claim, damage, loss, liability, cost, or expense (including reasonable legal fees) arising out of or in connection with: (a) Your breach of these Terms; (b) Your violation of any applicable law; or (c) Your infringement of any right of any third party.
10.2 The Operator reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by You, in which case You agree to cooperate with the Operator's defence.
§11Termination
11.1 The Operator may, at its sole discretion and at any time, without prior notice, terminate or restrict Your access to all or any portion of the Service, including for suspected breach of these Terms.
11.2 Sections 4, 5, 8, 9, 10, 12, 13, 14, and 15 of these Terms survive any such termination.
§12Changes to These Terms
12.1 The Operator may modify these Terms from time to time. The current version is identified by the Effective Date shown at the top of this page.
12.2 Material changes will be reflected by updating the Effective Date. Your continued use of the Service after such update constitutes acceptance of the modified Terms.
12.3 If You do not agree to a change, You must stop using the Service.
§13Governing Law
13.1 These Terms and any non-contractual obligation arising out of or in connection with them are governed exclusively by the substantive law of the Republic of Austria, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
13.2 Mandatory provisions of consumer-protection law of the country in which a User who is a consumer habitually resides remain unaffected.
§14Jurisdiction
14.1 Subject to §14.2, exclusive jurisdiction for any dispute arising out of or in connection with these Terms or the Service shall lie with the competent courts of Vienna, Austria.
14.2 If You are a consumer habitually resident in an EU Member State other than Austria, You may bring proceedings against the Operator in the courts of Your country of residence, as required by Regulation (EU) No 1215/2012 (Brussels I bis). The Operator may sue You only in the courts of the EU Member State in which You are domiciled.
§15Severability and Entire Agreement
15.1 If any provision of these Terms is held by a competent court or authority to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be deemed replaced by a valid provision that most closely reflects the economic intent of the original provision.
15.2 These Terms, together with the documents expressly referenced (in particular the CC BY-SA 4.0 licence applicable to the verb-paradigm data and any future Impressum and Privacy Policy published on the Service), constitute the entire agreement between You and the Operator regarding the Service and supersede any prior agreements.
§16Contact and Operator Information
16.1 For licensing inquiries, takedown requests, permission requests, or any other communication regarding these Terms, please use the contact details published on the Impressum page of the Service.
